1. GENERAL PROVISIONS
1.1.
These Terms of Service set out the rules for using the petschoiceclub.pl online store and the rules for concluding sales contracts through this store.
1.2.
The Service Provider and Seller is PETSCHOICE.CLUB ANTON ARKHYPENKO, with its permanent place of business at: ul. Przasnyska 4B/239, 01-756 Warsaw, Poland, Tax Identification Number (NIP): 5253066055, National Business Registry Number (REGON): 543081647, email: support@petschoiceclub.pl, phone: +48 800 003 058.
1.3.
The online store operates using the Shopify platform.
1.4.
These Terms apply to both consumers and other store users, provided that certain provisions apply exclusively to consumers.
1.5.
Matters not covered by these Terms are governed by the relevant provisions of Polish law and applicable European Union law, in particular provisions concerning consumer rights, the provision of electronic services, and personal data protection.
1.6.
By using the store, creating an account, subscribing to marketing communications, or placing an order, the user confirms that they have read these Terms and the Privacy Policy available on the store website.
2. DEFINITIONS
2.1.
Store — the online store available at petschoiceclub.pl.
2.2.
Seller / Service Provider — PETSCHOICE.CLUB ANTON ARKHYPENKO.
2.3.
Customer — a natural person, legal entity, or organisational unit using the Store or entering into a contract with the Seller.
2.4.
Consumer — a natural person who enters into a legal transaction with the Seller for purposes not directly related to their business or professional activity.
2.5.
Account — an individual user panel created in the Store, if such functionality is available.
2.6.
Goods / Product — movable property offered for sale in the Store.
3. TYPE AND SCOPE OF ELECTRONIC SERVICES
3.1.
Through the Store, the Seller provides electronic services, including in particular:
- enabling users to browse the Store’s product range;
- enabling users to place orders;
- enabling users to create and maintain an Account, if such functionality is available;
- enabling users to contact the Seller through forms or contact details available on the website;
- enabling users to subscribe to commercial information, if such an option is available.
3.2.
Electronic services are generally provided free of charge, except where a payment obligation arises directly from the nature of the contract entered into, in particular a sales contract for Goods.
3.3.
The contract for the provision of electronic services is concluded when the user begins using the relevant Store functionality; in the case of an Account, it is concluded upon successful completion of registration.
4. TECHNICAL REQUIREMENTS
4.1.
Use of the Store requires:
- a device with Internet access;
- an up-to-date web browser supporting cookies and JavaScript;
- an active email address;
- in some cases, an active telephone number, where necessary to fulfil the order.
4.2.
The Seller makes every effort to ensure that the Store can be used by users of popular web browsers and devices.
5. RULES FOR USING THE STORE AND ACCOUNT
5.1.
The user is required to use the Store in a manner compliant with the law, good practices, and these Terms.
5.2.
The user is required to provide true, current, and complete information.
5.3.
The user may not:
- provide unlawful content;
- infringe the rights of third parties;
- undertake activities that interfere with the operation of the Store;
- gain unauthorised access to IT systems;
- use automated tools, bots, scrapers, or similar solutions in a manner that violates security or the Seller’s interests.
5.4.
If the Store allows the creation of an Account, the user is responsible for keeping login credentials confidential and for all activities undertaken through their Account.
5.5.
An Account may not be shared with third parties.
6. PRODUCTS AND PRODUCT INFORMATION
6.1.
We make every effort to ensure that product descriptions, photographs, prices, and other information presented in the Store are accurate and current.
6.2.
Product photographs are for illustrative purposes. The actual appearance of a product may differ slightly from its presentation on screen, in particular due to the user’s device settings.
6.3.
Information published in the Store does not constitute an offer within the meaning of the Polish Civil Code, but an invitation to enter into a contract.
6.4.
We reserve the right to change the product range, product descriptions, and prices, and to withdraw products from sale, provided that such changes do not affect rights acquired by Customers before their introduction.
7. PLACING ORDERS AND CONCLUSION OF THE SALES CONTRACT
7.1.
Placing an order by the Customer constitutes an offer to enter into a sales contract for the products indicated in the order.
7.2.
To place an order, it is necessary to:
- add the selected product to the cart;
- provide the information necessary to fulfil the order;
- select a delivery and payment method;
- confirm the order and accept these Terms.
7.3.
After placing an order, the Customer receives an email confirming that the order has been received.
7.4.
The sales contract is concluded when the Customer receives an email confirming that the order has been accepted for fulfilment.
7.5.
The order confirmation is sent to the email address provided by the Customer when placing the order.
8. PRICES AND PAYMENTS
8.1.
All prices presented in the Store for the Polish market are expressed in PLN and include VAT where applicable under the relevant regulations to the particular product or transaction.
8.2.
The total order price, including product prices and delivery costs, is displayed before the order is placed.
8.3.
The currently available payment methods are indicated during the order process and at checkout. The Store may make available, in particular, card payments, BLIK, Apple Pay, Google Pay, PayPal, Shop Pay, or other payment methods technically displayed in the cart, provided they are active at the relevant time.
8.4.
The Customer is required to make payment using the method selected when placing the order.
8.5.
In the event of an obvious pricing or technical error, we reserve the right to cancel the order before fulfilment, provided that the Customer is notified promptly and any payment received is refunded.
9. SHIPPING AND DELIVERY
9.1.
Shipping rules, order-processing times, and estimated delivery times are described in the Shipping Policy available on the Store website.
9.2.
Delivery costs are indicated to the Customer before the order is placed.
9.3.
The stated delivery times are estimates, unless expressly stated otherwise.
9.4.
The risk of loss of or damage to the goods passes to the Consumer when the Consumer, or a third party designated by the Consumer other than the carrier, takes possession of the goods. If the Consumer independently chooses a carrier that was not offered by the Seller, the risk passes when the goods are handed over to that carrier.
10. RIGHT OF WITHDRAWAL
10.1.
A Customer who is a Consumer has the right to withdraw from a distance contract without giving any reason within 14 days from receiving the goods.
10.2.
To exercise the right of withdrawal, the Customer should send an unambiguous statement to: support@petschoiceclub.pl.
10.3.
The Customer may use the model withdrawal form attached to these Terms, although this is not mandatory.
10.4.
In the event of withdrawal from the contract, the Customer should return the goods without undue delay and no later than 14 days from sending the declaration of withdrawal.
10.5.
In the event of an effective withdrawal from the contract, we will reimburse all payments received from the Customer, including the cost of the least expensive standard delivery method offered in the Store for the relevant order, without undue delay and no later than 14 days from receiving the declaration of withdrawal.
10.6.
We may withhold reimbursement until we receive the returned goods or the Customer provides proof of sending them back, whichever occurs first.
10.7.
The refund will be made using the same payment method used by the Customer, unless the Customer expressly agrees to a different refund method that does not involve any additional costs.
10.8.
The Customer bears the direct cost of returning the goods when withdrawing without giving a reason, unless expressly stated otherwise.
10.9.
Detailed return rules, information on exceptions to the right of withdrawal, and complaint rules are described in the Returns and Complaints Policy available on the Store website.
10.10.
In addition to the statutory right of withdrawal, the Seller may offer a voluntary return period of up to 30 days from receipt of the order, subject to the rules described in the Returns and Complaints Policy.
11. COMPLAINTS — LACK OF CONFORMITY OF GOODS WITH THE CONTRACT
11.1.
If the goods received are not in conformity with the contract, a Customer who is a Consumer has the right to submit a complaint.
11.2.
The Seller is liable to the Consumer for any lack of conformity of the goods with the contract that existed at the time of delivery and becomes apparent within 2 years from the date of delivery.
11.3.
A complaint may be submitted by email to support@petschoiceclub.pl or in writing to the Seller’s address.
11.4.
To help us process your complaint efficiently, we recommend providing:
- order number;
- description of the problem;
- photographs of the product and packaging, where possible;
- the Customer’s requested remedy.
11.5.
A fiscal receipt is not the only acceptable proof of purchase. A complaint may also be made on the basis of other proof of purchase.
11.6.
In the event of a lack of conformity of the goods with the contract, the Customer may exercise rights arising from applicable law, in particular request repair or replacement of the goods and, in cases provided for by law, a price reduction or withdrawal from the contract.
11.7.
We will respond to a complaint no later than 14 calendar days from the date of its receipt, where applicable law requires such a response in relation to the request made.
11.8.
If the complaint concerns a lack of conformity of the goods with the contract, the costs of collection, shipment, repair, replacement, or refund are borne by the Seller in accordance with applicable law.
12. COMPLAINTS ABOUT ELECTRONIC SERVICES
12.1.
Complaints concerning the operation of the Store, Account, or other electronic services may be submitted to: support@petschoiceclub.pl.
12.2.
The complaint should preferably include:
- information allowing the user to be identified;
- a description of the problem;
- the date on which it occurred;
- the user’s request.
12.3.
Complaints concerning electronic services are considered within a reasonable time, no later than 14 days from receipt.
13. INTELLECTUAL PROPERTY
13.1.
All content published in the Store, including text, photographs, graphics, trademarks, visual identity elements, website layout, and other materials, is protected by copyright and other intellectual property rights.
13.2.
Use of materials available in the Store is permitted solely for personal, non-commercial use and in a lawful manner.
13.3.
Copying, distributing, modifying, or using Store content for commercial purposes without the Seller’s prior written consent is prohibited.
14. OPINIONS, REVIEWS, AND USER CONTENT
14.1.
If a user submits an opinion, review, comment, photograph, or other content, they represent that they have the right to share it and that it does not infringe third-party rights or applicable law.
14.2.
By submitting such content, the user grants the Seller a non-exclusive, royalty-free, worldwide licence to use it in connection with operating the Store, marketing, and presenting products, subject to applicable law and the user’s rights.
14.3.
We reserve the right to refuse publication of or remove content that is contrary to the law, good practices, or these Terms.
15. THIRD-PARTY LINKS AND SERVICES
15.1.
The Store may contain links to third-party websites or services.
15.2.
We are not responsible for the content, terms, or privacy policies applied by such entities. Use of their services is subject to the terms established by those providers.
15.3.
The Store uses technical, payment, logistics, analytics, or marketing solutions provided by third parties, including Shopify and payment service providers.
16. LIABILITY
16.1.
We make every effort to ensure that the Store operates properly and that information published in the Store is accurate and current.
16.2.
We do not guarantee uninterrupted availability of the Store, in particular in the event of technical interruptions, maintenance work, failures, force majeure, or circumstances beyond our control.
16.3.
To the maximum extent permitted by law, we are not liable for indirect damages, lost profits, or interruptions in the use of the Store resulting from circumstances beyond our control.
16.4.
Nothing in these Terms excludes or limits consumer rights arising from mandatory provisions of law.
17. PERSONAL DATA
17.1.
The rules for processing personal data are set out in the Privacy Policy available on the Store website.
17.2.
By using the Store, the user confirms that they have read the Privacy Policy.
18. CHANGES TO THE TERMS
18.1.
We reserve the right to update these Terms for important reasons, in particular in the event of:
- changes in legal regulations;
- changes to payment or delivery methods;
- technical or organisational changes in the operation of the Store;
- an extension or change in the scope of services offered.
18.2.
The current version of the Terms will be published on the Store website together with the date of the last update.
18.3.
Changes do not affect contracts concluded before they enter into force, unless applicable law provides otherwise.
19. OUT-OF-COURT DISPUTE RESOLUTION AND APPLICABLE LAW
19.1.
Consumers may use out-of-court methods for handling complaints and pursuing claims, in particular through appropriate ADR entities, the Trade Inspection Authority, or with the support of a municipal or district consumer ombudsman.
19.2.
Up-to-date information on out-of-court consumer dispute resolution is available on the websites of the Polish Office of Competition and Consumer Protection (UOKiK) and the Consumer Redress in the EU service.
19.3.
These Terms and contracts concluded through the Store are governed by Polish law, taking into account mandatory provisions protecting Consumers.
19.4.
Any disputes will be resolved by the competent common courts, subject to the Consumer’s rights under applicable law.
